1 · The agreement
This is an agreement between you and the maker of PodoCut for use of the PodoCut software. By installing or using it you accept these terms. If you do not accept them, do not install it — and if you have already paid, ask for a refund under section 7.
2 · What you are buying
You are buying a licence to use PodoCut, not the software itself. The licence is granted to one person, is not exclusive, and cannot be transferred to somebody else without our agreement.
It does not expire. There is no renewal date, and the version you bought keeps working.
3 · How many machines
Two machines, for one person, not at the same time. A desktop and a laptop is the intended case.
Each machine signs in against your licence. To move to a different machine, sign out on the old one from the panel’s About window and sign in on the new one.
4 · What you may not do
- Share your sign-in with anyone else, or use one licence across a team.
- Resell, rent, sublicense or redistribute PodoCut, or include it in a product or service you sell.
- Reverse-engineer, decompile or disassemble it, or work around the licence check, except where the law expressly gives you that right regardless of this agreement.
- Remove or alter any notice of ownership in the software.
Buying for a team is fine and welcome — write to us and we will set up a licence that covers it.
5 · Your footage and your projects
Your footage, your audio and your Resolve projects are yours. We claim no right of any kind over them, and PodoCut does not send them anywhere: detection and cutting happen entirely on your machine. See the privacy notice for the only thing that does leave it.
Anything PodoCut produces — timelines, cuts, edits — is yours to use however you like, commercially or otherwise.
6 · Signing in, and staying signed in
PodoCut requires an internet connection to start an edit, because it confirms your licence with our server each time. This is what keeps a single licence from being shared, and it is a condition of the licence. Everything after that check runs offline on your machine.
We may withdraw a licence if it is being used in a way section 4 forbids. If we do, we will tell you why at the address on the account.
7 · Refunds
Write to us within 14 days of buying and we will refund the $100 in full. There is no trial, so the refund is how you try it. The full terms are on the refunds page.
8 · Updates
Updates are included at no extra cost, including new major versions, and PodoCut installs them itself. An update is covered by this same licence.
We are not obliged to keep making updates indefinitely, but the version on your machine keeps working either way.
9 · What we do not promise
PodoCut is provided as it is. We do not warrant that it will be free of faults, that it will suit a particular purpose, or that it will produce a specific editing result — an automatic cut is a starting point for an edit, not a finished programme.
PodoCut always creates a new timeline and does not modify your existing edits; where you explicitly ask it to work in an existing timeline, it saves a full copy of the project first. Even so, keep your own backups. That is true of any software that touches your work.
10 · Liability
To the extent the law allows, our total liability to you under this agreement is limited to the amount you paid for the licence. We are not liable for lost work, lost time, lost profit, or any indirect or consequential loss.
Nothing here limits liability that cannot be limited by law — including for death or personal injury caused by negligence, or for fraud. If you are a consumer, this agreement does not affect your statutory rights.
11 · Ending the licence
You may stop using PodoCut at any time; uninstall it from Windows settings. We may end the licence if you break section 4 and do not put it right after we ask. If the licence ends, stop using the software — timelines you have already produced remain yours.
12 · Not affiliated with Blackmagic Design
PodoCut is an independent product. DaVinci Resolve is made by Blackmagic Design, who have no involvement in PodoCut and provide no support for it. Blackmagic Design’s own terms govern your use of Resolve.
13 · Governing law
To be completed before launch. The governing law and jurisdiction depend on the entity selling the licence, which is not yet settled. This section will name both before PodoCut goes on sale.
14 · Changes to these terms
We may update these terms for future purchases. The terms that apply to your licence are the ones published on the day you bought it, and this page keeps a last-updated date so you can tell.
